22 | Because ash is licensed free of charge, I provide absolutely no

23 | warranty, to the extent permitted by applicable state law. Except

24 | when otherwise stated in writing, Kenneth Almquist and/or other
|

25 | parties provide ash "as is" without warranty of any kind, either
|
---|
26 | expressed or implied, including, but not limited to, the implied
|
---|
27 | warranties of merchantability and fitness for a particular purpose.

28 | The entire risk as to the quality and performance of the program is
|
---|
29 | with you. Should the ash program prove defective, you assume the cost
|
---|
30 | of all necessary servicing, repair or correction.

32 | In no event unless required by applicable law will Kenneth Almquist

33 | and/or any other party who may modify and redistribute ash as permitted
|

34 | above, be liable to you for damages, including any lost profits, lost

35 | monies, or other special, incidental or consequential damages arising

36 | out of the use or inability to use (including but not limited to loss
|

37 | of data or data being rendered inaccurate or losses sustained by third
|

38 | parties or a failure of the program to operate with programs provided

39 | by other parties) the program, even if you have been advised of the

40 | possibility of such damages, or for any claim by any other party.
